Pleas before the Court of Common Pleas within and for the County of Geauga and State of Ohio at a term of said Court begun and held at the court house in Chardon, on the fifth day of June in the year of our Lord one thousand eight hundred and thirty seven.

The State of Ohio on complaint of Grandison Newell) Recognizance to keep the Peace.

Be it remembered, that at this term of said court, that is to say, at the term thereof firs <​above​> written, Edward Flint Esq. a Justice of the Peace within and for the township of Painesville in said county of Geauga, certified and sent to the Clerk of said Court, a transcript from his docket, in the words and figures following to wit:

Painesville, Geauga County, Ohio.— Justices Court— On the complaint of Grandison Newell made before me, April 13th. 1837, that he had just cause to fear & did fear, that Joseph Smith Jr. would kill him or procure other persons to do it, warrant issued for said Smith same day & returned by George Lockwood Const. with deft. in court May 30th. 1837 & not being ready on part of the defendant this cause was continued until June 3d. 1837, deft in the custody of the Const. at which time deft was again returned by said const. & Orson Hyde, N[ewel] K. Whitney, Oliver Cowdery, Sidney Rigdon, Jared Carter, David Whitmer, Quartus Clark, R[eynolds] Cahoon, S[olomon] W. Denton, Luke Johnson & Warren Parrish were sworn & part of them examined on part of the prosecution, & Sidney Rigdon, Lora [Lory] Holmes, Almond [Almon] Babbitt, Jonathan Herrington, C[ornelius] P. Lott, Hiram [Hyrum] Smith, Reynolds Cahoon, Abner Balster [Bolster], Oliver Granger & Elijah Abels [Able] were sworn & examined on part of the deft— And after hearing the testimony & allegations of the parties in said case, deft. was recognized in the sum of five hundred dollars for his appearance to the next court of Common Pleas of said county on the first day of the term thereof & in the mean time to keep the peace & be of good behaviour generally & especially towards the complainant in this suit— & Sidney Rigdon, S. W. Denton & Orson Hyde were recognized in the sum of $50.00 each as wit[nesse]s. in said case—Before me June 3d 1837. Edward Flint Justice of the Peace. Orson Hyde, Oliver Cowdery, M[arvel] C. Davis, Sidney Rigdon, Jared Carter, Vincent Knights [Vinson Knight], David Whitmer, were in attendance as witnesses 1[s]t day made Sat[isfaction]—

I do hereby certify that the foregoing is a true & correct transcript of the proceedings as had before me & recorded on my docket in said case. Given under my hand & seal at Painesville June 3d. 1837. Edward Flint Justice of the Peace L.S.”

And thereupon the Court having heard the evidence adduced, are of opinion that the complainant had no cause to fear as set forth in his said complaint— It is therefore adjudged by the court, that the said Joseph Smith Junior be discharged, and go thereof without day—at the costs of the State taxed at [blank]
